河南一學(xué)校奇葩規(guī)定:懷孕意味著辭職

  A private primary school that banned its teachersfrom getting pregnant during the fall semester hastrigged public debate over women's reproductiverights.

  一所私立小學(xué)禁止教師在秋季學(xué)期懷孕的規(guī)定引起了公眾對婦女生育權(quán)的激烈辯論。

懷孕被辭職

  Shangqiu Shangbo School in Shangqiu, CentralChina's Henan Province has been under fire sinceearly February when a netizen who claimed to be ateacher at the school said on Weibo that the schooloffered no maternity leave and fired femaleemployees that got pregnant.

  從2月開始,位于中國中部的河南省商丘尚博學(xué)校一直受到網(wǎng)民的攻擊。原因是一名自稱是該校老師的網(wǎng)友在微博上表示,學(xué)校不提供產(chǎn)假并解雇懷孕女員工。

  According to a photo attached to her Weibo post, the school's teaching contracts state thatteachers will be fined 2,000 yuan ($305) if they get pregnant during the fall semester and couldnot continue their work in the spring semester. The fines will be used by the school to pay forsubstitute teachers.

  跟據(jù)她的微博上附帶的一張照片顯示,學(xué)校的教學(xué)合同規(guī)定,如果教師在秋季學(xué)期懷孕并不能繼續(xù)春季學(xué)期工作時,將被罰款2000元(折合305美元)。這些罰款將被學(xué)校用來支付替補(bǔ)老師的工資。

  Liu Zhu, the school's headmaster, confirmed that the contract posted online was authenticand said four teachers signed the contracts willingly and that they can continue their workafter giving birth, news portal thepaper.cn reported on Friday.

  根據(jù)新聞門戶澎湃新聞上周五報道,該校校長劉柱已經(jīng)證實,網(wǎng)上發(fā)布的合同是真實的,但是四名教師是自愿簽訂該合同的,她們在生育后可以繼續(xù)回來工作。

  Liu said that the school, founded in 1999, has 60 teachers and more than 1,100 students. Theschool offers no paid maternity leave, Liu admitted, adding that the contract is designed toavoid frequent changes of teachers and to protect students' interests. "We don't wantteachers to quit midway. It is irresponsible to frequently change their teachers," Liu said.

  劉校長表示,學(xué)校成立于1999年,目前共有60名教師和1100多名學(xué)生。劉校長承認(rèn)學(xué)校提供無薪產(chǎn)假,同時他還補(bǔ)充說,合同的目的是為了避免教師的頻繁變動并保護(hù)學(xué)生的權(quán)益。“我們不想讓老師中途辭職。頻繁換老師是對學(xué)生的不負(fù)責(zé)任,”劉校長說。

  However, lawyers have argued the contract violates China's law on the protection of womenand children, which forbids labor contracts from restricting employees' marriage orreproduction. "The contract is clearly against the law, and hence is not legally binding," LiHuayang, a lawyer based in Zhengzhou.

  但是,律師已經(jīng)表示,該合同違反了中國的《婦女兒童權(quán)益保護(hù)法》。該法律禁止勞動合同限制雇員的婚姻或生育。鄭州的一名名叫李華陽的律師表示,“這份合同顯然是違法的,因此不具有法律效力,”
