China's administration of Industry and Commerce issued a draft refund policy for online shopping on Wednesday. The policy was issued to solicit public opinion.
工商總局周三(9月27日)發(fā)布網(wǎng)購?fù)素涋k法草案,向社會公開征求意見。
The draft lays out that customers can refund products purchased online within seven days. The customer can return products without giving reason and they must be responsible for the return shipping fee.
草案規(guī)定,消費(fèi)者網(wǎng)購商品七天之內(nèi)可以無理由退貨,但是要承擔(dān)退貨運(yùn)費(fèi)。
此次七天無理由退貨辦法涉及的不僅是網(wǎng)絡(luò)購物(online shopping),經(jīng)營者采用電視、電話、郵購等方式銷售商品(TV shopping, telephone shopping and postal shopping),也參照本辦法執(zhí)行。
雖然辦法規(guī)定消費(fèi)者可以無理由退貨,但是有七種情形的商品不適用七日無理由退貨規(guī)定:
消費(fèi)者定做的商品(custom-made products);
鮮活易腐的商品(fresh or perishable goods);
在線下載或者消費(fèi)者拆封的音像制品、計算機(jī)軟件等數(shù)字化商品(audiovisual products downloaded or unfolded, digital products like computer software);
交付的報紙、期刊(newspapers and periodicals);
消費(fèi)者在購買時確認(rèn):
拆封后易導(dǎo)致商品性質(zhì)改變、影響人身安全或者生命健康的商品(products that change or undermine people's health once unpacked);
一經(jīng)激活或者試用后價值貶損較大的商品(products largely devalued after activated or used);
銷售時已明示的臨近保質(zhì)期的商品、有瑕疵的商品(products that the customer is aware will soon expire or are flawed)。
此外,《征求意見稿》還規(guī)定消費(fèi)者退回的商品應(yīng)當(dāng)完好(returned products is supposed to remain in good condition)。消費(fèi)者退貨時應(yīng)當(dāng)將商品本身、配件及贈品一并退回(any gifts or accessories from the merchant must be returned together with the purchased products)。如果贈品不能一并退回,經(jīng)營者可以要求消費(fèi)者按市場價支付贈品價款。
